1. Definitions

In these Terms, the following words carry the meanings set out below:

• "Rim Suan" / "We" / "Us" / "Our" — Rim Suan Senior Living Residence and its authorised staff
• "You" / "User" — any individual visiting this website or submitting an enquiry through it
• "Resident" — an individual who has entered into a formal residency arrangement with Rim Suan
• "Services" — the residency options and associated amenities described on this website
• "Agreement" — the written residency agreement signed between Rim Suan and a Resident or their authorised representative
• "Website" — this website accessible at https://rimsuanvs
• "Content" — all text, images, data, and other materials appearing on the Website

2. Acceptance of Terms

By accessing and using this Website, you confirm that:

• You are at least 18 years of age, or are acting as an authorised representative for someone considering residency
• You have the legal capacity to accept these Terms
• You accept these Terms in full as they stand at the time of your visit

Submitting a contact form enquiry does not create a binding residency commitment on either party. A formal signed Agreement is required before any residency arrangement commences.

3. Description of Services

Rim Suan offers three non-medical senior living residency options in Hua Hin, Thailand:

• Discovery Day Visit — A one-day guided introduction to the residence and community (฿4,900 per visit)
• Extended Comfort Stay — A month-long trial residency with full community participation (฿17,500 per month)
• Permanent Home Membership — A long-term residency arrangement in a private suite (฿28,500 per month)

Rim Suan is a non-medical residence. We do not provide nursing care, clinical monitoring, or medical treatment of any kind. Individuals whose needs require full-time medical supervision are not suited to our services, and we communicate this openly during the enquiry and assessment process.

Availability of specific suites and dates is subject to current capacity at the time of booking.

4. User Responsibilities

When using this Website, you agree to:

• Provide accurate and complete information in any enquiry or booking submission
• Use the Website only for lawful purposes
• Not attempt to gain unauthorised access to any part of the Website or its underlying systems
• Not use automated tools to scrape, copy, or index Website content without written permission
• Not submit content that is false, misleading, offensive, or designed to disrupt the Website

5. Residency Arrangements

5.1 Discovery Day Visit

Bookings are confirmed upon receipt of the applicable fee and written confirmation from Rim Suan. Cancellations requested more than 48 hours before the scheduled visit are eligible for a full refund. Cancellations within 48 hours of the visit date are non-refundable, except where exceptional circumstances apply at our reasonable discretion.

5.2 Extended Comfort Stay

The Extended Comfort Stay is governed by a short-form agreement confirming the commencement date, included services, and payment terms. A minimum of 14 days' notice is required if a Resident wishes to end the stay before the end of the month. No partial refund is issued for departures within a paid month unless agreed otherwise in writing.

5.3 Permanent Home Membership

The Permanent Home Membership is governed by a separate written Agreement reviewed and signed by both parties. This Agreement sets out all terms including notice periods, included services, annual review arrangements, and the process for making changes to the residency. In the event of any conflict between these Website Terms and the signed Agreement, the Agreement takes precedence.

5.4 Pricing

All prices are stated in Thai Baht (฿) and are inclusive of the services described for each option on this Website. Rim Suan reserves the right to revise pricing with at least 30 days' written notice. Existing signed Agreements are not subject to unilateral mid-term price changes without the Resident's written consent.

6. Intellectual Property

All Content on this Website — including text, photographs, layout, branding, and code — is owned by or licensed to Rim Suan. You may view and print Content for personal, non-commercial reference only. No Content may be reproduced, modified, distributed, or commercially exploited without prior written permission from Rim Suan.

The Rim Suan name and associated branding are proprietary and may not be used without express written authorisation.

7. Payment Terms

Payment for the Discovery Day Visit is required at the time of booking. Payment for Extended Comfort Stays is due on commencement. Payment for Permanent Home Membership is due monthly in advance, as specified in the signed Agreement. Accepted payment methods are confirmed during the booking process. All payments are in Thai Baht unless otherwise agreed in writing.

8. Disclaimers

This Website is provided for informational purposes in good faith. Rim Suan makes no warranties, express or implied, regarding the accuracy or completeness of the information herein. Details — including availability, pricing, and services — may change. We encourage prospective residents and families to confirm current details directly with our team before making any decision.

Nothing on this Website constitutes medical advice. Rim Suan does not make representations regarding suitability for any individual's health or care requirements. Those with complex medical needs should consult a qualified healthcare professional before considering a non-medical senior residence.

9. Limitation of Liability

To the fullest extent permitted by the laws of the Kingdom of Thailand, Rim Suan shall not be liable for any indirect, incidental, special, or consequential loss arising from your use of this Website or reliance on its Content. Our total liability for any direct claim relating to Website use shall not exceed the amount paid (if any) in connection with the specific service to which the claim relates.

Nothing in these Terms limits or excludes liability for personal injury, death, or loss caused by Rim Suan's own negligence or wilful misconduct.

10. Indemnification

You agree to indemnify and hold harmless Rim Suan, its directors, staff, and agents from and against any claims, losses, costs, or liabilities arising from your use of the Website in breach of these Terms or applicable law.

11. Termination

Rim Suan may suspend or restrict access to this Website at any time without prior notice. Termination or early conclusion of a residency arrangement is subject to the terms of the applicable signed Agreement, which includes notice periods and exit procedures for both parties.

12. Third-Party Links

This Website may contain links to external services, including embedded maps and other third-party platforms. Rim Suan is not responsible for the content, accuracy, or privacy practices of any external website. Use of external links is at your own discretion.

13. Children

Rim Suan's services are directed at adults aged 18 and above. This Website is not intended for use by minors. We do not knowingly collect personal information from individuals under 18.

14. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand. Any dispute arising from these Terms or use of the Website shall first be addressed through good-faith communication between the parties. Where a dispute cannot be resolved informally within 30 days, it shall be referred to the competent courts in Prachuap Khiri Khan Province, Thailand.

For international residents and families, Rim Suan is committed to a constructive resolution process before formal proceedings are pursued.

15. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy (and any signed residency Agreement), constitute the full understanding between you and Rim Suan regarding use of this Website.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
• Waiver: Failure by Rim Suan to enforce any provision at any time does not constitute a waiver of that provision.
• Assignment: You may not transfer your rights or obligations under these Terms to any third party without prior written consent from Rim Suan.
• Notices: Legal notices to Rim Suan should be sent to legal@rimsuanvs or to our postal address below.

16. Changes to These Terms

Rim Suan reserves the right to update these Terms from time to time. The updated Terms will be posted on this page with a revised "Last Updated" date. Continued use of the Website after any update constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
